Amendment 219(C) to the Policing and Crime Bill would require all religious marriages to comply with English and Welsh marriage laws. Baroness Cox of the House of Lords proposed and defended the amendment in her statements to the House of Lords on November 16, 2016.

In a divorce proceeding, the Circuit Court of Fairfax County upheld a couple’s marriage contract. On appeal, defendant Ali Afghahi raised several arguments against the validity of the contract, and claimed that upholding it would be inequitable; he also made several evidentiary objections, including that the marriage contract as admitted was not the original document and should therefore be barred according to the “best evidence rule.” He further argued that as no expert was called to testify about the meaning of marriage in Islamic cultures, the judgment was unenforceable. The appellate court rejected these arguments and affirmed the judgment against him (and in favor of the validity of the marriage contract), concluding that his objections were untimely because he had not raised them in the lower court.

At issue in this case is the validity of a marriage performed in the Islamic tradition, where the husband sought an annulment of an initial “traditional” marriage and recognition of a subsequent civil marriage. The law of the Philippines does not require a couple to obtain a marriage certificate if their marriage is performed according to the Islamic tradition; accordingly the couple married under traditional Islamic law and obtained no certificate. In seeking annulment of that marriage and recognition of a subsequent marriage, appellant Rafiqul Islam argued that the first marriage was not official; he further argued that the union was not truly Islamic because his so-called wife was not Muslim, because the wedding ceremony was performed by a clerk rather than a religious official, and because neither party intended to enter into a marital relationship. On appeal, the Court upheld the trial court’s decision that the first marriage was a legitimate, state-recognized union, and thus that any subsequent marriage would be considered void.

The Ohio Court of Appeals affirmed the trial court’s refusal to enforce an Islamic marriage contract, which called for a postponed dowry (mahr) owed by the husband to the wife upon death or divorce of $25,000. The Court found that the groom was coerced into signing the agreement, and thus it was not valid. The Court did not delve into the potential First Amendment Establishment Clause issues considered by the Franklin County Court of Common Pleas.

The first defendant (Neima Mohamed, herein Neima), as the plaintiff in the court of first instance, had submitted that:

1. On 4 April 2004, she and the plaintiff (Mostafa Mohamed, herein Mostafa) were married;
2. On 28 February 2005, the parties had executed a pre-nuptial financial agreement that would regulate their financial affairs during and after their marriage;
3. The agreement stated that Mostafa should pay to Neima $50,000.00 if he initiated separation or divorce proceedings against her; and
4. On 11 September 2008, Mostafa Islamically divorced Neima.

Mostafa denied marrying Neima, did not admit points 2 and 3, and denied Islamically divorcing her. Moreover, Mostafa submitted that any separation of the parties had been initiated by Neima.

Before the court of first instance, Mostafa denied having been married to Neima under Islamic law. Her Honour Magistrate Trad did not answer that question, but rather found that the parties had been in a 'domestic relationship'. Regardless, the parties could not agree who initiated the separation and on which date the separation occurred. Mostafa claimed that Neima had initiated the separation on 11 September 2008 by taking his key to their Rockdale unit, while Neima claimed that Mostafa, on 11 April 2007, had asked her to leave their home, and alternatively, on 11 September 2008, had Islamically divorced her.

On the facts, Magistrate Trad found that Mostafa had initiated the divorce on 11 April 2007, further evidenced by him sending his daughter to tell Neima to leave by a certain date, with directions as to the division of their property. Therefore, her Honour found that sufficient evidence existed to activate cl 11 of the parties' agreement, compelling Mostafa to pay to Neima the agreed-upon sum of $50,000.00 (Moackar Sadak or dowry).

On appeal, Harrison AsJ found that Mostafa could appeal the initial decision pursuant to s 69 of the Supreme Court Act 1970, which granted the Court jurisdiction to quash the decision of a lower court if based on an error of law. Mostafa sought to dispute the findings of Magistrate Trad in their entirety on the following grounds:

1. that her Honour had made errors of fact and law;
2. that the decision suffered from jurisdictional error;
3. that her Honour had failed to acknowledge that the agreement had not been executed in accordance with the law;
4. that her Honour had failed to find that the agreement was unenforceable because it conflicted with public policy; and
5. that her Honour had erred by failing to find that the separation, for the purposes of the agreement, did not have to accord with shari'a law.

With regards to appeal ground 4, Mostafa submitted that her Honour had failed to recognise that the agreement was one of servitude in that it compelled Mostafa to remain in a relationship with Neima, lest he pay her $50,000.00. Moreover, it was contrary to public policy for her Honour to determine which party had left the relationship, and cl 11 was void for illegality as it was a penalty clause. The Court found the precedent cited in support of its submission by Mostafa's counsel to be somewhat irrelevant. It found the precedent cited by Neima's counsel, which stated that the court would, where possible, hold parties seeking separation or divorce to their agreement, relevant. The Court also acknowledged the issue of the payment of Moackar Sadak, noting that the lack of any precedent regarding such payment in Australia may necessitate seeing how other common law countries have approached such agreements. The Court also provided a brief discussion on mahr, based on Ann Black and Kerrie Sadiq's, 'Good and Bad Sharia: Australia's Mixed Response to Islamic Law' (2011) 17 UNSW Law Journal 82, noting that mahr appeared to be what the parties meant by Moackar Sadak. The Court found that cases dealing with mahr from the United States, Canada and the United Kingdom all found such agreements enforceable, provided they could not be invalidated for other reasons. Counsel for Neima submitted that, while some customs might be contrary to public policy, what is of utmost importance in enforcing such an agreement is that the parties to the agreement knowingly and voluntarily adhered to those customs.

Harrison AsJ found that, in enforcing such agreements, courts of common law countries have applied common law or the relevant legislation (if any), rather than sharīʿa law. Moreover, that none of these courts found that agreements such as that made by the parties in this instance contradict public policy. Harrison AsJ also dismissed Mostafa's argument that it was not for the Court to decide who left the relationship, stating that '[c]ourts are often called upon, especially in family matters, to determine sensitive factual matters such as when a relationship has ended, or whether it was indeed a de facto relationship...'.

With regards to Mostafa's submission that cl 11 was a penalty clause, Harrison AsJ disagreed. Her Honour found that the Property (Relationships) Act and the Family Law Act allowed parties to enter into financial agreements. Moreover, that cl 11 formed part of the 'greater bargain' between the parties.

Harrison AsJ also dismissed Mostafa's submissions that the court of first instance did not have jurisdiction to adjudicate the validity of the agreement, or to determine whether or not the parties' separation had to accord with sharīʿa law. The Court found that as the agreement had neither specified an appropriate dispute resolution forum or jurisdiction (common law or sharīʿa law), nothing precluded the court of first instance from adjudicating the case. Secondly, that Magistrate Trad had not considered the meaning of 'divorce' under sharīʿa law, instead determining when the separation had occurred on the facts. The Court also noted that Mostafa had not relied on any expert evidence relating to sharīʿa law, and that Magistrate Trad was in no way required to apply sharīʿa law to interpret the parties' agreement.

Mostafa's counsel conceded the inapplicability of the Property (Relationships) Act but argued that Magistrate Trad had applied it regardless. The Court found it irrelevant whether or not the agreement satisfied the requirements of the Property (Relationships) Act, stating that Magistrate Trad had correctly applied the laws of contract to the agreement.

Mostafa also submitted that as the parties had not been married under Australian law, the agreement was unenforceable because the terms 'separation' and 'divorce', per cl 11 of the agreement, are inapplicable to de facto relationships. The Court agreed to consider whether or not marriage under Australian law was a condition precedent to the enforceability of the agreement, but concurred with Neima's counsel that, among other submissions, the agreement did not specify marriage under Australian law as a condition precedent to the enforceability of the agreement, or to cl 11 specifically. Moreover, that the word 'separation' is distinct from 'divorce' and is applicable to the cessation of a de facto relationship. The Court also noted that the agreement was to secure the parties' individual assets, as both parties had been previously married and had significant assets individually.

With regards to which party initiated the separation and on what date, Harrsion AsJ noted Magistrate Trad's deliberations and that her Honour was unable to rely on any 'so-called independent witnesses' because all the evidence provided by witnesses had been informed by what the parties had told them. Magistrate Trad had, therefore, relied on Neima's evidence that, on 11 April 2007, the parties had argued and Mostafa had waved a knife in front of Neima. That evening Mostafa's daughter, accompanied by a police officer, had come to collect some of Mostafa's belongings and to give her a list separating the parties' belongings. On 13 April 2007, Neima moved out of the parties' unit. While the parties had attempted to reconcile, in September 2008, following another argument, Mostafa said the words 'you are divorced' to Neima. Mostafa denied this, stating that Neima had initiated the separation in September 2008 by asking him to leave their Lakemba unit. Mostafa also denied saying the words 'I divorce you'.

All other submissions made by Mostafa on appeal were dismissed on the grounds that they were not covered in Mostafa's submissions. Harrison AsJ also found that Magistrate Trad had made her findings pursuant to ample evidence. Harrison AsJ noted that this appeal raised religious and cultural issues not previously dealt with by the Australian courts, and that the question of how such agreements should be dealt with would be referred to the Australian Law Reform Commission and NSW Law Reform Commission for their consideration.

A UK family court considered whether and how UK law recognizes a marriage conducted according to Islamic law that had not been accompanied by a civil law marriage. The husband contended that the couple was never married, and the wife—petitioning for divorce—insisted that they were. The two had signed an Islamic marriage contract (nikāḥ) accompanied by a ceremony abroad, lived together and had children together, and held themselves out as married for years both abroad and in the UK. The court concluded that, on those facts and considering the UK laws on marriage—as interpreted, for the first time, through the Human Rights Act 1998 and the best interests of the child—that the marriage was “void” or “voidable.” This determination meant that the couple was not validly married under UK law but that their union was also not considered a non-marriage. Instead, as a void marriage, their union was something akin to what Islamic law would label a “defective marriage.” The court had essentially concluded that, although a marriage was not properly concluded or registered according to the law, the steps taken toward one would in some measure be recognized by the law and entitle the wife to certain legal protections upon dissolution of the union. In this case, this meant that the wife was entitled to a decree of nullity from the court, and that the wife could take advantage of certain UK civil law remedies for maintenance and child custody upon dissolution.

The appellate court upheld the Superior Court of Orange County’s refusal to divide marital property in the context of a divorce according to Islamic law. The plaintiff introduced a marriage certificate as a “premarital contract,” which, among other things, lays out a set amount to be paid to the wife in the event of a divorce. The lower court refused to consider the certificate a “contract,” as it was not clear that both parties were expressly agreeing to the same terms, consistent with their understanding of Islamic law and custom.

On December 26, 2008, Mariam Ayad ("Wife") and Ayad Hashim Latif ("Husband") got married.  They executed a prenuptial agreement ("Islamic Prenuptial Agreement") on the same day, which the wife alleges she considered to be a customary marriage certificate, not a contract conferring substantive rights and limitations on the Husband and the Wife, respectively.  The couple have a son.  Their marriage started deteriorating in 2020, at which point the Wife alleges she learned for the first time about the existence of the Islamic Prenuptial Agreement and the fact that she had executed it on the day of her marriage with her Husband.  On January 25, 2021, the Wife filed for divorce.  The Husband countersued for divorce and filed a motion to have the Islamic Prenuptial Agreement enforced, which provides that all divorce-related matters, including spousal support, child support, alimony, and marital property division, shall be resolved through the ruling of a fiqh panel to be convened.  The trial court, in rejecting the Wife's arguments regarding the invalidity and unenforceability of the Islamic Prenuptial Agreement, which the Wife had argued based on her assertion that she had thought she was signing a cultural document at the time of signing and that she was not given an opportunity to read and understand the terms, ruled in favor of the Husband and held that the prenuptial arrangement be enforced. 

The Wife appealed to the appellate court seeking relief from the order of referral to arbitration of the trial court.  In her submission to the appellate court, the Wife made four separate arguments:

1. The Islamic Prenuptial Agreement is void on grounds of contravening public policy, as the agreement clearly disavows Texas law and the laws of the United States, and replaces those with Islamic Law, which, according to the Wife's submission, "limits the rights of a woman to obtain a divorce," in violation of Equal Protection, the Establishment Clause, and Due Process, given the different weights assigned by Islamic law to official testimony from women compared to men.

2. The Islamic Prenuptial Agreement is void as a matter of Texas contract law because the agreement was involuntarily executed.

3. The trial court abused its discretion in finding that the Islamic Prenuptial Agreement stipulated to arbitration, as the agreement does not contain evidence of a meeting of the minds as regards an intent to arbitrate.  The agreement's mention of a "fiqh panel" or a "Muslim court" cannot unequivocally be read as an agreement to arbitrate.

4. Relatedly, the trial court also abused its discretion in referring the dispute to arbitration without allowing the Wife to present meaningful evidence refuting the existence of an alleged agreement to arbitrate.

The case is pending before the Texas appellate court.

This Court reversed the decision of the Circuit Court of Hillsborough County that prevented a wife from collecting her deferred dowry (sadaq), the dowry due from the husband to the wife upon marriage, a portion of which is deferred by agreement to be paid upon death or divorce. The husband argued that, under Islamic law, the wife forfeits her contractual right to the deferred dowry if, as here, she is the one to seek the divorce. This Court upheld the contract, holding that it was binding because there was a meeting of the minds, and the parties agreed that the deferred dowry would be due upon divorce.

In a divorce proceeding involving a prenuptial agreement (Islamic marriage contract) between a Muslim husband and wife, the California Court of Appeals considered the validity of a provision requiring the husband to pay 3,000 Jordanian dinars as well as 2,000 dinars of either cash or household furniture as a “deferred dowry” (known as mahr or ṣadāq) due to the wife upon death or divorce. The husband claimed that the deferred dowry is not due where, as here, the wife initiates the divorce proceeding. The court concluded that, regardless of the individual claims, requiring payment of one party to the other upon divorce was an example of prohibited “divorce profiteering” and that, “if the court had accepted the position of wife’s expert, the contract would not have been enforceable under the public policy of the state.” Accordingly, the Court upheld the lower court's decision not to enforce that provision of the agreement.

The Texas Court of Appeals reversed a state district court’s decision to uphold an Islamic marriage contract that awarded the wife a deferred dowry (mahr), an amount agreed upon at the time of marriage and due to the wife from the husband or his estate upon death or divorce, of $50,000. The district court had concluded that the amount was due pursuant to a marital contract made by the parties “in contemplation of a forthcoming marriage,” constituting “a valid, binding, and enforceable contract under Sections 4.001-003 of the Texas Family Code.” The appellate court reversed and remanded to the lower court, concluding that the agreement was not a valid premarital contract under the state law, defined as “an agreement between prospective spouses made in contemplation of marriage,” because the religious wedding ceremony occurred before the contract was signed. As the contract fell outside of the definition of premarital contract, the Court concluded that it could not be enforced like one. 

Xinjiang, officially the Xinjiang Uyghur Autonomous Region, is a region in Central Asia and home to several ethnic groups, including the Uyghur, Kazakhs, Tajiks, Kyrgyz, in addition to a large Han Chinese population. In recent years, the conflict between Uyghurs and the Beijing government has intensified due to the government’s policies of mass surveillance, increased arrests, and a system of “re-education camps,” which reportedly held more than a million Muslim ethnic groups. The 2017 Regulation was introduced as providing legal justifications for the government’s mass detention policies on anti-terrorism grounds. It was enacted on March 29, 2017 by the Standing Committee of the People’s Congress of the Xinjiang Uighur Autonomous Region, the region’s legislature. Article 14 of the 2017 Regulation authorized the government to effectuate “education and transformation” through “individual and collective” education programs. Article 48 further authorized criminal penalties for violation.

The plaintiff petitioned the Court to bury his wife according to Islamic legal requirements over the objections of her family. The plaintiff claimed that he and his wife had shared the Islamic faith and had married by way of an Islamic marriage ceremony the previous year. However, they never obtained a marriage license, and there was no proof of her faith or burial wishes. The Court found in favor of the deceased’s parents, concluding that, without a marriage license, the plaintiff was not her surviving spouse before the law. Therefore, the deceased was to be buried according to her parents' wishes. The Court did not view this as a potential First Amendment Free Exercise issue.

A district court in Lahore, Pakistan, ruled against a man who had remarried without obtaining his wife’s permission. Judicial magistrate Ali Jawad Naqwi ruled that the accused, Shehzada Saqib Suhail, had illegally pursued a third marriage without first obtaining the consent of the complainant, Ayesha Khalil, who at the time was his second wife. The magistrate ruled that the accused had “solemnized third marriage during the existence of marriage with the complainant and therefore accused namely Shahzada Saqib Suhail is convicted u/s 6(5) of Muslim Family Ordinance.” In its opinion the court cited section 6 of Muslim Family Ordinance 1961 which stipulates the manner and practice of polygamy in Pakistan. 6(5) of the Ordinance disallows any man from contracting an additional marriage without the permission and consent of the Arbitration Council. Under the ordinance, an application for permission must be submitted to the Chairman of the Arbitration Council along with the necessary fees, reasons for marriage, and importantly, proof of consent of existing wife or wives. The court found that no such permission had been obtained from the second wife the complainant, Ayesha Khalil, nor from the Arbitration Council when the third marriage was established, and sentenced accused with six months of simple imprisonment and fine of Rs.2,00,000/.

This enactment of August 3, 1948, "provide[s] for the solemnization and registration of church and civil marriages." It deals with all marriages except those "contracted according to the usages of the Mohammedans, Hindus, Buddhists, Dayaks and other persons governed by their own laws or customs." It names neither the Sultan nor the British Resident, and does not specify an author or enacting authority.

Chapters on nominate contracts (endowment, sales, options, barter/ mu‘āwaḍa, hire and lease, partnerships -shirka, muzāra‘a, musāqāt, muḍāraba-, reward/ju‘āla, deposit, fungible and non-fungible loan, agency, financial and personal guaranty, assignment, settlement, pledge, gift), shuf‘a, wills, inheritance, marriage and divorce, mahr, and alimony took almost all of its substance from prominent Shi’i fiqh treatises. Other chapters (classification of properties, easement, usufruct, general rules of obligations and contracts, nationality, registration of civil status, domicile, engagement, guardianship, and evidence) are mainly influenced by Swiss and French Civil Codes and Swiss Code of Obligations.

This section of al-Jarīda al-Rasmiyya officially promulgates the first two books of the Moroccan Personal Status Code, the Mudawwana. The first book presents the stipulations concerning marriage, including issues such as the contract, dowry, and inhibitors (like number of wives). The second book deals with the dissolution of marriage, thus addressing conditions of repudiation, women’s repudiation, and the ʿidda (the woman’s waiting period until she may remarry).

The Court found the decision of the Lhoksukon Shari'a Court (lower court) to grant the respondent an irrevocable divorce (talak satu ba'in sughra) to be erroneous. This was because the lower court had initially determined that the respondent was seeking a divorce on the grounds that the appellant had breached a term of their marriage contract (taklik talak), when in actual fact the respondent sought a divorce due to ongoing conflict (syiqaq). The Court stated that this change in reason conflicted with the relevant sections of the Guidelines on the Implementation of Tasks and Justice Administration.

Regardless, the Court also found that it had already been established that the parties had been separated since 3 January 2007, and noted that the appellant had conceded to not providing the respondent with emotional and financial support. This had been corroborated by information provided by witnesses. Accordingly, the Court found that, as the respondent's failure to provide such support contravened figures 2 and 4 of the marriage contract, there was no need for the respondent to change the legal rationale for which she sought a divorce. Instead, it granted the respondent a divorce upon her paying to the appellant a sum of money (iwath) to obtain his consent (talak satu khul'i).
