To fund construction for a new building without violating Islamic law's prohibition against interest, the Islamic Center of Nashville (ICN) entered into an ijāra agreement with Devon Bank; the bank created a subsidiary for the purpose of the ijāraagreement. Under the agreement, Devon Bank had legal ownership of the building's title until ICN could fully purchase the building. After ICN paid the amount for the building's construction, ownership was transferred to ICN from Devon Bank. ICN applied for a property tax exemption, including for the time period in which Devon Bank held the title for the building. The state of Tennessee denied ICN the exemption for the period in which Devon owned the building, but granted it for the time after. ICN appealed that decision. 

Plaintiff Leila Diab, an observant Muslim teacher who was hired to teach social studies and English as a second language, filed a suit against the Respondents, the Chicago Board of Education and John F. Kennedy High School Principal George Szkapiak, alleging that the Respondents discriminated and retaliated against her, and further subjected her to a hostile work environment, on the basis of her Islamic faith. The Plaintiff alleged that she was forced to resign from her teaching position following anti-Islamic comments made by the principal and various teachers at the Kennedy high school. The Plaintiff further claimed that she received a hate mail note (which read: “Israel is doing OK) and that her Qur'an was desecrated on school property [in violation of norms taken to be governed by Islamic ritual law, of treating the Qur'an with respect]. In response, the Respondents filed a motion for summary judgment, seeking dismissal of the complaint. The District Court determined that in order to prevail on her discrimination claims, the Plaintiff had to show that the Respondents subjected her to an adverse employment action, such as: "(1) termination or reduction in compensation, fringe benefits, or other financial terms of employment; (2) transfers or changes in job duties that cause an employee's skills to atrophy and reduce future career prospects; and (3) unbearable changes in job conditions, such as a hostile work environment or conditions amounting to constructive discharge." Barton v. Zimmer, Inc., 662 F.3d 448, 2011 WL 4921603, at *4 (7th Cir. 2011). The Court granted the Respondent’s motion as to the Plaintiff’s hostile work environment claims, finding that it could not conclude that a reasonable jury would find the note, taken together with the Qur'an incident nine months later, to create a hostile work environment. While the Court acknowledge that the incidents may have proved upsetting to her, it observed that the two incidents were not repeated and did not involve any physical contact or verbal abuse.

The plaintiff, Dominic Ali, a Muslim inmate at the Northern New Hampshire Correctional Facility, sued several prison officials for allegedly violating his rights under the First and Fourteenth Amendments, the Religious Land Use and Institutionalized Persons Act (RLUIPA), and the state's constitution. The plaintiff alleged that the prison failed to provide jumu'a (Friday prayer) services for Muslim inmates, failed to ensure that he was provided with healthy food during Ramadan (the Islamic month of fasting), and denied him the ability to observe Ramadan by removing his name from the prison's internal Ramadan fasting list. The defendants filed a motion for summary judgment, arguing that the plaintiff's claims should be dismissed because he did not exhaust his administrative remedies before bringing suit. The Court agreed: it found that the plaintiff had not brought his grievances to the attention of the prison's commissioner, and therefore granted the defendants' motion.

The plaintiffs, a group of inmates held at the Massachusetts Correctional Institute in Concord, filed suit against Massachusetts prison officials for alleged violations of their rights under the First and Fourteenth Amendments and the Religious Land Use and Institutionalized Persons Act (RLUIPA). The plaintiffs alleged that the prison officials violated these rights by refusing to provide separate accommodations for adherents of the Nation of Islam, whose practices (according to one of the plaintiffs) are "distinctly different" from those of Sunnī Islam. The magistrate judge recommended that the defendants' motion to dismiss be allowed because the plaintiffs had not yet exhausted their administrative remedies within the prison system.

The plaintiff, Remon Shields, a prisoner serving a life sentence without parole, brought this action against the California Department of Corrections and Rehabilitation, alleging that his religion requires those who want to marry to get married and consummate their relationship, but his request for non-overnight "family visiting" with his wife were denied. The prison contended that there is a policy stating that those who are serving a life without parole sentence are ineligible for the family visiting program. The respondent filed a motion to dismiss. The District Court granted the respondent's motion to dismiss, determining that there was no fundamental right to conjugal visits, and that the plaintiff had not demonstrated that the prison regulation prohibiting conjugal visits for life-without-parole prisoners was not rationally related to a valid penological interest.

The plaintiff, Michael Mootry, sued prison officials for implementing a policy that he claimed constituted a violation of his First Amendment rights. The policy banned inmate ministers from leading religious services without the direct supervision of a hired chaplain or volunteer. As a result of this policy, for two years, Muslim inmates were not accommodated with a hired chaplain to supervise jumu'a (Friday prayer) services. The Court denied the defendants' motion to dismiss because it found that the defendants knew about the plaintiff being prevented from participating in the prayer services, that this was an ongoing issue, and that they did nothing to correct the situation.

The plaintiff, Kiaza Loccenitt, a Muslim inmate in the custody of the New York City Department of Correction, sued New York City and several prison officials for allegedly violating his civil rights by denying him ḥalāl meals and by denying him and other Muslim inmates in his unit the services of an imām (Muslim chaplain). The plaintiff alleged violations of his rights under the First Amendment of the U.S. Constitution, pursuant to 42 U.S.C. § 1983 and the Religious Land Use and Institutionalized Persons Act of 2000, as well as New York Corrections Law § 610. In response to the defendants' motion for summary judgment, the Court dismissed the plaintiff's claims against some of the prison officials (who were not directly involved in the alleged violations or the creation of policies that led to the alleged violations), but allowed the plaintiff to file an amended complaint to add factual details to his allegation about being denied ḥalāl meals, and about "the impact of that denial on the practice of his religion."

The plaintiff, Tracey Taylor, a pretrial detainee in the Cook County Department of Corrections (Illinois), brought an action, pursuant to 42 U.S.C. § 1983, against the respondents Cook County and Sheriff Thomas Dart for alleged violations of his civil rights in denying him access to Islamic prayer services and by failing to serve ḥalāl meat (prepared in accordance with Islamic law). The respondents moved for summary judgment after alleging that Taylor failed to exhaust his administrative remedies and failed to raise a genuine issue of material fact as to whether they violated his constitutional rights. The Court granted summary judgment for the respondents, determining that the denial of Islamic prayer services was related to a legitimate penological interest, and that the prison had adequately provided the plaintiff with sufficiently nutritious Islamic meals, even though they were vegetarian/vegan.

Plaintiff Leo Pittman-Bey, a Muslim inmate, sued Texas prison officials for allegedly violating the Religious Land Use and Institutionalized Persons Act and his constitutional right to free exercise of religion under the First Amendment by denying him after-sunset meals during the Islamic holy month of Ramadan. Previous prison regulations allowed practicing Muslim inmates to receive after-sunset meals during Ramadan, but only if they had attended jumuʿa (Friday prayer) services in the 60 days prior to Ramadan or had received a special exception from the Muslim chaplain. Pittman-Bey did not attend the services because, as an adherent of the Ḥanafī school of Sunnī Islam, he said he believed that jumuʿa services are not proper if conducted in nonpublic settings like prisons. The District Court granted summary judgment for the defendants, determining that denying Ramadan meals in accordance with the jumuʿa attendance policy did not violate the First Amendment.

Plaintiff Dorian Davis challenged the Kern Valley State Prison policy that prohibited Muslim prisoners from purchasing and possessing prayer oils in their cells. The prison officials, however, claimed that a compelling governmental interest made their policy the least restrictive means of ensuring prison safety. The District Court agreed with them, determining that the prison did not violate the plaintiff's First Amendment rights because the Muslim chaplain had previously provided contraband to prisoners; in addition, it found that RLUIPA rights were not violated because the prison had to cancel Friday prayer services until another Muslim chaplain could be hired.

The plaintiffs, two Muslim prisoners, sued state and prison officials for failing to provide Muslim inmates with ḥalāl meat options while incarcerated. The defendants claimed that inmates in the custody of the state are not entitled, under either the First Amendment or RLUIPA, to a diet that includes ritually-slaughtered meat. The defendants also requested summary judgment because they claimed that Wells-Bey did not have an allergy to eggs that inhibited his ability to eat a lacto-ovo diet as a substitute for meat. The Court determined that the defendant was not entitled to summary judgment because the plaintiff claimed he had an egg allergy and therefore could not subsist off the vegetarian meal plan; however, the Court allowed the defendants to refile their motion if they were able to obtain more information about the plaintiff's "alleged allergy."

A Muslim female teacher sued her former employer, the Board of Education for the School District of Philadelphia, as well as the Commonwealth of Pennsylvania under Title VII, alleging religious discrimination. The defendant school board argued that it suspended and ultimately fired the plaintiff under the Pennsylvania Garb Statue (Public Law No. 282) when she refused to remove her headscarf while teaching. The U.S. District Court for the Eastern District of Pennsylvania found in favor of the defendant Commonwealth, but against the School Board. The Third Circuit affirmed the decision against the Commonwealth but reversed the decision against the School Board, holding that, while the statute may present conflicts with the First Amendment, to bring a claim under Title VII, as the plaintiff did, requires proving that the accommodation would not be an undue burden for the employer. The Court further held that allowing teachers to wear religious garb would be an example of an undue burden, as it threatens the religious neutrality of the public school system. The Court upheld the conclusion of the District Court that “the Commonwealth was not [plaintiff’s] employer within the meaning of Title VII."

Plaintiff Peter McDaniels sued various prison officials, alleging that they intentionally failed to provide him with pre-sunrise meals during Ramadan and with an Eid al-Fitr meal at the conclusion of Ramadan, in violation of his First Amendment rights to free exercise of religion. The Plaintiff also contended that the lack of provision of ḥalāl meat and deprivation of an Arabic Qurʾān for nine months were discriminatory violations of his rights. The Respondents moved for summary judgment. The District Court granted the Respondents' request for summary judgment on the Ramadan meals issue, stating that the Plaintiff failed to show that such failures to provide a meal on isolated incidents imposed a significant restriction on his religious practice. However, the District Court decided that the Respondents did not meet their burden of demonstrating that the religious diet policy furthers a compelling government interest and is the least restrictive means of furthering that compelling interest. The District Court dismissed the plaintiff's claim that the Respondents deprived the Plaintiff of his rights by not allowing him access to a Qurʾān, finding that the Respondents were not required to provide the Plaintiff with an Arabic Qurʾān or dates to be used in his devotional practice, given the absence of any showing that Respondents prevented him from obtaining such items. The Plaintiff did not seek injunctive relief, but the Court found that the individual Respondents were entitled to qualified immunity, so they could not be held liable for personal damages under RLUIPA.

Plaintiff Tabari Strong, a Muslim prisoner in Beeville, Texas, filed a lawsuit alleging that the prison's grooming policy requiring all inmates to be clean-shaven violated his statutory rights under RLUIPA. He also claimed that the policy violated his right to exercise his religion under the First Amendment, and that enforcement of the policy violated his right to equal protection under the Fourteenth Amendment. The plaintiff filed a motion for summary judgment, claiming that he is entitled to a declaratory judgment. The District Court refused to grant the plaintiff's request for injunctive relief as an "extraordinary remedy," but maintained that it would be contrary to justice not to grant the relief requested by the plaintiff to have a quarter-inch beard.

The appellate court affirmed the district court's judgment on the basis of the Tax Injunction Act, which prohibits federal courts from hearing challenges to tax obligations if the taxpayer has adequate access to judicial review in state courts.  

Plaintiff Kevin Murray, an American taxpayer, sued Treasury Secretary Timothy Geithner and the Board of Directors of the Federal Reserve, arguing that the Emergency Economic Stabilization Act (EESA), which established the Troubled Asset Relief Program (TARP), violated the Establishment Clause of the First Amendment by allowing funds to be used to support companies that invest in sharīʿa-compliant financial instruments. Applying the Lemon Test to assess whether there was excessive entanglement between religion and state related to Islamic financial instruments, the Court concluded that there was not; specifically, it determined that the Islamic financial instruments comprised only a small percentage of the complete business portfolio, that the purpose of the EESA was not religious, and that the primary effect of utilizing the Islamic financial instruments did not support or hinder any religion. Accordingly, the Court granted summary judgment in favor of the defendants.

Plaintiff Kevin Murray, an American taxpayer, sued Treasury Secretary Geithner and the Board of Governors of the Federal Reserve, challenging use of the Troubled Asset Relief Program (TARP) funds created by the Emergency Economic Stabilization Act (EESA) to bailout AIG, a “market leader in Sharia-compliant financing.” The Court denied summary judgment in favor of the defendant, finding that the bailout of AIG by the government may raise First Amendment Establishment Clause issues. This decision was overturned in a 2011 appeal, in which this same Court granted summary judgment in favor of the defendant, holding that the plaintiff had not made out a sufficient case that would allow a jury to conclude, under the Lemon Test (which assesses whether there is excessive entanglement of the Government with religion) that the Treasury Secretary violated the Establishment Clause by allowing AIG investment in sharīʿa-compliant financial instruments.

A female Muslim police officer, Kimberlie Webb, sued the City of Philadelphia under Title VII and the Pennsylvania Religious Freedom Protection Act, alleging religion- and gender-based discrimination. Specifically, the plaintiff objected to the City barring her from wearing a headscarf (ḥijāb) with her police uniform, and argued that the prohibition amounted to a failure to accommodate her right to free exercise of religion under the First Amendment. The City argued that the bar was consistent with Philadelphia Police Directive 78 and that allowing her to wear religious garb would cause an undue burden on the City and the Police Department, in that it would compromise a look of cohesiveness and uniformity among officers. The Court concluded that the plaintiff failed to exhaust internal remedies regarding her claim of gender discrimination and found the bar on the headscarf to be a compelling state interest. Accordingly, the Court upheld the U.S. District Court for the Eastern District of Pennsylvania, granting the City’s motion for summary judgment.

The plaintiff (KH. Moch. Yusman Roy) was the caretaker of Jamaah Pengajian Lelaku at Pondok Iktikaf, an i'tikaf (seclusion in a mosque) study group venue in Malang, East Java, where Qur'anic study and recitation activities were held, and the production of prayer carpets (sajadah), pillows, and bolsters was conducted. The defendant, the Regent (Bupati) of Malang, had issued a decree declaring the cessation of the activities of Jamaah Pengajian Lelaku at Pondok Iktikaf. The plaintiff submitted that he had received the decree, dated 7 May 2005, through a family member. On 6 May 2005 at 8.00pm, however, the plaintiff submitted that he had been arrested and interrogated by the Malang Regional Police. Therefore, the legal process had been implemented prematurely and without authority. Moreover, that in issuing the decree, the defendant had acted unilaterally, without considering all the relevant concerns. Therefore, pursuant to art 53(1) and (2)(a) and (b) of Law No. 9 of 2004 on Amendments to Law No. 5 of 1989 on the State Administration of the Judiciary, as the plaintiff had suffered loss as the result of a state administrative decree, he was entitled to submit a written application to the authorised court seeking that the decree be declared null and void, and seeking damages as an additional remedy. The plaintiff also requested that the court suspend the implementation of the defendant's decree, pursuant to art 67(2) of Law No. 5 of 1986, and that the investigation of the case be conducted as quickly as possible, pursuant to art 98 of Law No. 5 of 1986.

In its exceptions, the defendant submitted that the plaintiff's submissions were incorrect and inaccurate because the plaintiff had already submitted a request for protection, dated 6 May 2005, to the Malang Regional Police, expressing concern and fear for the consequences of his having taught sholat and do'a (prayers) in both Arabic and Indonesian. The plaintiff's conduct had allegedly generated a negative reaction from the community towards the plaintiff. It was in accordance with the plaintiff's request that the Malang Police conducted its investigation and arrest on 7 May 2005. The legal consequences that followed had, therefore, resulted from the plaintiff's request, rather than the issuance of the regental decree. The regental decree had been issued in consideration of Presidential Determination No. 1 of 1965 on the Prevention of Abuse and/or Defamation of Religion, meaning that both an administrative action and criminal conduct had occurred, for the purposes of art 10 of Law No. 32 of 2004 on Regional Administration. Moreover, purusant to art 27(1)(c) of Law No. 32 of 2014, the regental decree had been issued in accordance with the obligations of a regional head to maintain peace and order. More specifically, it was issued in anticipation of anarchic reactions from other parties who did not share the religious opinions of the plaintiff that it was acceptable to conduct sholat in Indonesian, as well as the original Arabic.

The defendant also submitted that the state administrative court was precluded from adjudicating the case pursuant to art 49 of Law No. 5 of 1986, because it had issued the regental decree during a time when the public interest dictated it do so. In addition to adhering to Presidential Determination No. 1 of 1965, the regental decree also accorded with art 156(a) of the Criminal Code because it acknowledged that the plaintiff's conduct was defamatory towards a religion.

The court dismissed the defendant's exceptions in their entirety. It reiterated the constitutioanlly-guaranteed freedom to practise one's religion and beliefs in accordance with their own conscience, as found in art 28E(1) and (2) of the 1945 Constitution, as well as Law No. 39 of 1999 on Human Rights. The court noted that these guarantees derive from the Universal Declaration of Human Rights 1948, which identifies basic human rights and freedoms which are naturally connected to, and inseparable from, humans from the moment they are born. The court also noted, however, that as the defendant had deemed the activities of Pondok Iktikaf Jamaah Njagi Lelaku to have the potential to disturb the peace and order of the community, it was of the opinion that the cessation of these activities constituted a preventative measure to protect the human rights of others, and that maintaining the peace was in the public interest, per art 73 of Law No. 39 of 1999, which states that rights and freedoms can only be limited by, and pursuant to, statute. Accordingly, the court dismissed the plaintiff's request that the regental decree issued by the defendant be revoked on the grounds that it was not contrary to any statute. Moreover, it dismissed the plaintiff's request that the defendant reinstate the good name of the plaintiff on the same grounds.

In this circuit court decision, which affirms the district court's judgment striking down the Oklahoman constitutional amendment to prohibit courts from considering "Sharia Law" in their decisions, the Court rules that the constitutional amendment violates Muslim petitioner's right to free exercise, as the ban imposed prevents him from engaging in many religious acts such as executing a will. The amendment also sends an unmistakable message to the Muslim community that they are considered outsiders - a message that is impermissible under the Federal Constitution.
