The parties were married on 8 December 2010 and had three children. The plaintiff submitted that she and the defendant had lived happily together for 10 years and one month, although their marriage had been volatile at times. In June 2010, the parties had begun to quarrel often, primarily because the defendant had had an extra-marital affair, which the plaintiff had learned out about from Facebook and the defendant himself.
The plaintiff left the matrimonial home in July 2010 and had not returned in the five months leading up to the proceeding. Throughout that five months the parties had not been physically intimate, however, the defendant had provided the plaintiff with some financial support. The parties had also maintained some form of communication.
While being counselled by the court, the plaintiff expressed a desire to reconcile with the defendant and withdrew her application. The court acceded to the plaintiff's decision.
