The parties were married on 21 January 2005 and had lived at the applicant's home for a year (until January 2006). While they had already consummated their marriage, they had no children. The applicant submitted that, since July 2005, the marriage had been disharmonious, however, because the respondent found his salary as a labourer unsatisfactory. The respondent left the applicant in January 2006, returning to her childhood home. The parties then remained separated for the next eight years and nine months. The applicant, accordingly, requested that the court grant him a revocable divorce (talak satu raj'i).
After corroborating the applicant's submissions with evidence provided by the applicant's witnesses, the court acceded to his request, pursuant to art 19(f) of Government Regulation No. 9 of 1975, and art 116(f) of the Compilation of Islamic Laws, on the grounds of ongoing conflict between the parties.
