This status update states that art 108(1) of Law No. 36 of 2009 on Health is not legally binding if the term health personnel (tenaga kesehatan) is not read down as pharmaceutical personnel (tenaga kefarmasian), and in the event pharmaceutical personnel are not available, certain health personnel can conduct limited pharmaceutical practices, including doctors and/or dentists, midwives, and nurses, where the situation is life-threatening and immediate medical attention is required to save a patient.
The status update also notes that art 108(1) of the elucidation is of no legal effect.
